Terms of Use
Last updated: 16 October 2026
BetterWords: Speaking Coach, previously called TalkBetter, is operated by Daniel Aneke. These Terms cover the BetterWords app, betterwithwords.com and the related speaking-practice services we provide (together, the “Service”). In these Terms, “we”, “us” and “our” mean Daniel Aneke, and “you” means the person using the Service.
Questions or support requests can be sent to support@betterwithwords.com. Our Privacy Policy explains how we handle personal information.
1. Your agreement and legal rights
Please read these Terms before accepting them in the app or making a purchase. When you accept these Terms through the Service, they form an agreement between you and us. If you do not agree, do not create an account or purchase a paid feature.
Nothing in these Terms excludes, restricts or changes any right or remedy that cannot lawfully be excluded, restricted or changed. This includes applicable rights under New Zealand's Consumer Guarantees Act 1993, Fair Trading Act 1986 and Privacy Act 2020, and mandatory consumer protections that apply where you live. Those protections take priority over any conflicting provision below.
Accepting these Terms does not replace a separate permission we are required to obtain before recording audio or processing or sharing personal information for a particular purpose.
2. Using an account
You must have the legal capacity or authorisation needed to use the Service and make any purchase. If the law where you live requires a parent or guardian's involvement, you must have that involvement. An App Store content rating does not determine whether you can enter a contract or give a legally valid permission.
Provide accurate account information, protect your sign-in details and tell us if you suspect unauthorised access. Do not impersonate another person or use someone else's account without permission. You are responsible for your own conduct; responsibility for unauthorised activity depends on the circumstances and applicable law.
Some features need compatible equipment, internet access or microphone permission. Your network provider may charge for data. A feature that needs audio cannot operate without the relevant microphone access.
3. Speaking practice and feedback
BetterWords provides speaking practice, playback and feedback. Features may include recordings, transcripts, exercises, sample conversations and automated coaching suggestions.
AI transcripts and feedback can be inaccurate, incomplete or unsuitable for a particular situation. Results can vary with language, accent, speech differences, recording quality and context. Listen back, review important suggestions and use your own judgement before relying on or sharing them. Scores and interpretations are practice aids, not objective judgments of your intelligence, character or personal worth.
BetterWords is a general educational and skill-development tool. It is not speech-language therapy, medical or mental-health care, diagnosis, or legal, financial or other regulated professional advice. It is not an emergency service. Seek an appropriately qualified professional for those needs. Do not use app feedback to make consequential decisions about another person's employment, education, insurance or access to services.
We do not promise a particular examination result, job offer, income, health outcome or rate of improvement. This does not reduce our duty to provide the care and quality required by law or to honour specific commitments made to you.
Where feedback is labelled “demo”, it is an authored example that illustrates the experience, not an analysis of your recording. Beta or test features may be unfinished or change. Keep a separate copy of recordings you need. A beta label does not remove your mandatory legal rights.
4. Recordings and other people's information
Record only when you intend to, and avoid accidentally capturing other people or confidential information. Your device's microphone permission is not permission from anyone else who may be recorded.
Before submitting someone else's voice, words or personal information, obtain the rights and informed permissions needed for recording, upload and processing for the feature you choose. Explain the relevant processing and sharing. If you cannot obtain the necessary permissions, do not include that person or their information. Recording and privacy laws differ between places; these requirements are also conditions of using BetterWords.
Do not submit confidential workplace or client material unless you are authorised to process it in this way. Avoid passwords, payment details, identity-document numbers and other sensitive information that is unnecessary for speaking practice. Do not use the Service for covert surveillance, impersonation or unauthorised voice imitation.
The Privacy Policy and relevant feature notices explain how recording information is handled. You can decline a feature-specific permission, although a feature that needs that permission may then be unavailable.
4A. Optional live talk, CrowdPlay and audio contribution
Where available, live talk connects you to Pip, an AI voice agent, using CrowdPlay. It is an audio-only feature. Calls are recorded and uploaded by CrowdPlay, and the recorded audio may be licensed to AI companies for AI development. Daniel Aneke may receive a share of licensing revenue. Live minutes offered in the app are the stated participation benefit; BetterWords does not promise a payment or royalty to you.
Live talk requires your separate agreement to the CrowdPlay consent wording displayed before the call and its linked Terms of Use and Privacy Notice. Read that notice before accepting. The licence and permissions for CrowdPlay’s use come from that separate agreement, not from a hidden extension of the ordinary service permission in section 5. We do not acquire ownership of your voice or identity through these Terms. We do not promise that your voice is anonymous or that provider-held copies can always be recalled.
You can decline live talk and use the other available practice features. A subscription, microphone permission, ordinary AI-feedback consent or website submission is not consent to live-call licensing. Only contribute material you have the rights and informed permissions to contribute, including for the disclosed licensing purpose. Comply with any eligibility requirements in the provider’s terms. Do not include another person’s voice or confidential information without the necessary permission.
To stop future live talk under this consent, turn off “Live talk recording” in Settings → Recordings and privacy; end any active call as well. Prior recordings, interrupted uploads, licensed copies and downstream use remain subject to CrowdPlay’s terms and applicable law. Deleting BetterWords copies, closing an account or withdrawing future consent does not by itself reverse an existing licence or completed AI training. Nothing here removes a legal right to request deletion, object to processing or challenge an invalid consent.
When you request coach notes from a live call and AI feedback is enabled, its transcript is separately processed through OpenRouter and OpenAI as described in the Privacy Policy. Live-call availability, duration and monthly limits are shown in the app and can depend on platform, subscription and consent status. Unused minutes are not cash or a transferable credit. Any change to a paid commitment remains subject to sections 7, 11 and your mandatory rights.
5. Your content
You keep any rights you have in recordings, text and other material you submit. You must have the rights needed to submit that material.
You give us a non-exclusive permission to receive, store, reproduce, transmit and technically process your material to provide the features you choose, operate and secure the Service, respond to your support requests and meet legal obligations. This includes processing by the service providers described in our Privacy Policy for the relevant tasks, subject to applicable privacy requirements.
This permission is limited to those purposes and does not transfer ownership of your recordings, voice or identity to us. A different use that requires additional permission must be explained and authorised separately. In particular, CrowdPlay audio contribution is governed by the separate consent in section 4A; this ordinary service permission does not authorise selling your practice recordings or training our own AI models on them. The permission continues only for as long as needed for the purposes above, including necessary lawful retention described in the Privacy Policy.
6. Our materials and acceptable use
We and our licensors retain rights in the app, website, branding, exercises and other materials we provide. You may use them through the Service for your own learning. Do not resell the Service or distribute our exercise library without permission. This does not restrict uses permitted by law or by an applicable open-source licence.
AI-generated feedback may resemble output given to other users and may not qualify for exclusive intellectual-property protection. We do not guarantee that an output is unique or clears every third party's rights. Review it before publishing it or using it commercially.
Do not use the Service to:
- Break the law or infringe privacy, intellectual-property or other rights.
- Harass, threaten, exploit or deceive anyone, or create abusive or non-consensual sexual material.
- Impersonate a real person or misrepresent generated speech as their genuine statement.
- Upload malware, bypass payment or access controls, interfere with the Service or access another user's information.
- Use automation or extract content in a way that disrupts the Service or exceeds clearly communicated limits.
- Reverse-engineer protected software except where applicable law or an open-source licence permits it.
Report misuse, an objectionable output or a security concern to support@betterwithwords.com. Do not send passwords or private recordings by email.
7. Paid features, subscriptions and refunds
This section applies when you choose a paid feature. The purchase screen shows the price, currency, billing period, included features and any trial or introductory offer before you confirm. Only purchase with a payment method you are authorised to use.
An auto-renewing subscription continues for successive billing periods unless cancelled. For purchases billed by Apple, payment and renewal are handled through your Apple Account. Manage or cancel your subscription in your Apple Account subscription settings. Apple's cancellation instructions explain the process. If you do not want a trial to renew, Apple advises cancelling at least 24 hours before it ends.
Deleting BetterWords or deleting your account does not itself cancel an Apple subscription. Check that cancellation is confirmed. The subscription settings show when access ends; trial access may end when you cancel. Cancellation stops future renewal but does not by itself determine whether a previous charge should be refunded.
For an Apple-billed refund request, use Apple's refund process. You can also contact us about a problem with the Service or a remedy you believe we owe you. The App Store refund process does not remove statutory rights against us or another responsible supplier.
Changes to recurring prices will be communicated through the applicable purchase platform, with any consent it requires. A changed price will not be applied retrospectively to an already-paid period. Any different billing method must be clearly identified before purchase with its cancellation instructions.
8. Website waitlist and beta questionnaires
The website waitlist helps Daniel Aneke, BetterWords’ founder, onboard people individually. To join this waitlist, provide your name, email address and phone number with country code, and actively agree to the contact described beside the form. Daniel uses the phone number only to contact you personally for one-to-one waitlist onboarding and help you get started with early access. This phone-number requirement applies to the website waitlist, not general use of the app. Joining the list does not guarantee an invitation or a particular onboarding date.
The form notice and our Privacy Policy explain how questionnaire answers are used to understand speaking-practice needs and plan beta support. Email contact about waitlist onboarding is included in the required agreement; email contact with related research questions is a separate, optional choice. Providing a number or accepting these Terms alone is not permission to call. Neither choice permits texts, marketing, automated outreach, call recording or audio-data contribution. You can withdraw contact permission by emailing support@betterwithwords.com. Earlier submissions keep their original permissions.
Do not include sensitive information or private details about other people in free-text answers. Submitting a questionnaire does not purchase a subscription, start a voice recording or authorise an audio-data contribution. Website questionnaire responses and app recordings are separate categories of information, handled for the purposes explained when they are collected.
9. Privacy, recording controls and account deletion
Our Privacy Policy explains account information, recording and transcript processing, service providers, overseas processing, retention and your privacy choices. Contact support@betterwithwords.com to request access to or correction of your personal information or to raise a privacy concern.
The app's recording controls are in Settings → Recordings and privacy. “Delete recordings” removes BetterWords audio, transcripts and feedback, including BetterWords copies of live-call transcripts and notes. Progress, pins, practice-day history and some operational records can remain. Server-audio retention cleanup alone does not delete all history. CrowdPlay recordings and licensed copies follow the separate arrangement described in section 4A and the Privacy Policy.
You can initiate account deletion in Settings → Account → Delete account. Account deletion is separate from cancelling an Apple subscription. Cancel renewal through Apple to avoid future charges. Some records may need to be retained for lawful purposes, as explained in the Privacy Policy; provider-held records and backups can have separate retention arrangements.
10. Third-party services and the Apple app licence
Some features rely on external technology providers. Their involvement does not remove our responsibilities to you. Our Privacy Policy and relevant feature notices explain the processing of personal information. If you choose to use a separate third-party service through a link, review its own terms before agreeing.
For apps obtained through Apple's App Store, the applicable app licence is Apple's Standard End User License Agreement, unless a custom licence is expressly provided for the app. These Terms describe our service relationship with you and do not replace the applicable app licence or mandatory consumer protections. Apple is not the provider of BetterWords coaching. Contact us for BetterWords support.
11. Changes to the Service and ending access
We may make reasonable changes to maintain or improve the Service, protect users or meet legal requirements. We will give reasonable advance notice of a material change affecting a paid feature unless urgent security or legal reasons prevent that. We will respect what you have already paid for and provide any cancellation rights or remedies required by law.
We may restrict access where reasonably necessary to address a serious breach of these Terms, unlawful use, fraud or a genuine security risk. Where safe and practicable, we will explain the reason and give you an opportunity to resolve the issue before ending access. Contact us if you think a restriction is mistaken.
You can stop using the Service at any time and use the cancellation and deletion options above. If we permanently discontinue a paid service or end your access without a breach by you, we will provide the applicable remedy for unused prepaid service. Any additional remedies required by law remain available.
12. Responsibility when something goes wrong
We will exercise the care required by law in providing the Service. We cannot promise uninterrupted availability or error-free AI output. Tell us about a fault so we can investigate and provide an appropriate remedy.
To the extent the law permits, we are not responsible for losses caused solely by your unlawful use of the Service or deliberate failure to follow a clear safety instruction. This does not exclude responsibility for our own acts or omissions or for providers for whom we are legally responsible.
No part of these Terms limits a liability or remedy that cannot lawfully be limited, including applicable consumer guarantees, privacy rights or liability for fraud or deliberate wrongdoing. The description of AI limitations explains the product; it does not excuse a failure to meet those obligations.
Subject to the protections above, we do not give an additional promise that the Service will meet every individual purpose, produce a particular result, or work continuously with every device or third-party service. You remain responsible for reviewing generated material, obtaining rights to material you submit, and making your own decisions. Our product descriptions and any express commitments remain binding to the extent required by law.
For claims to which a limitation can lawfully apply, we are not liable for business losses such as lost profit, revenue or business opportunity, or for losses that were not reasonably foreseeable when the relevant agreement was made. For those claims only, our total liability arising from the Service during a 12-month period is limited to the greater of NZ$100 and the fees you paid for the Service during that period. This limit does not apply to consumer guarantees or other non-excludable rights, our fraud or deliberate misconduct, personal injury or death where liability cannot lawfully be limited, or liability under privacy law that cannot lawfully be limited. It does not limit refunds or compensation required by law.
You are responsible for loss directly caused by your unlawful conduct or knowing infringement of another person’s rights. We do not require a blanket indemnity for ordinary use or for losses caused by our own fault. A third-party provider’s outage or conduct does not automatically release us from an obligation we owe you. Where events outside reasonable control prevent performance, we will take reasonable steps to reduce the effects and preserve any cancellation or refund rights required by law.
13. Updates to these Terms and resolving concerns
We may update these Terms for changes to the Service, law or genuine operational requirements. We will publish a dated version and give reasonable notice of material changes before they take effect. Where fresh agreement is required, we will ask for it. Changes will not retrospectively remove rights concerning an existing dispute or a purchase already made.
If you do not agree to a material change, you can stop using the affected service and cancel renewal before it applies. Any right to a refund or other remedy is preserved. A Terms update does not itself authorise a new use of personal information that requires separate permission.
Contact support@betterwithwords.com about these Terms or the Service. We will try to resolve concerns fairly. You can still use any regulator, tribunal or court available under applicable law; contacting us does not waive that right.
If a provision cannot lawfully be enforced, the remaining provisions continue to apply to the extent they can operate fairly without it. A delay in enforcing a provision is not a waiver. Any transfer of this agreement as part of a genuine business transfer must preserve your rights and our existing obligations, with any notice required by law.
14. New Zealand law and dispute resolution
New Zealand law governs these Terms and our service relationship with you. You and we submit to the non-exclusive jurisdiction of New Zealand’s courts and tribunals. This does not deprive you of mandatory protections under the law where you live or a right to bring a claim in a local court, tribunal or regulator where that right cannot lawfully be restricted. The applicable Apple app licence and your separate agreements with providers can have their own governing-law provisions; this section governs the agreement between you and Daniel Aneke.
You can contact us first at support@betterwithwords.com so we can try to resolve a concern. Doing so is not a condition of exercising a statutory right and does not shorten a legal time limit. These Terms do not impose compulsory arbitration or waive a right to use a regulator or tribunal. New Zealand consumer-law information is available from Consumer Protection, and privacy complaints can be raised with the Privacy Commissioner.
15. Notices and how these documents fit together
We may communicate service and legal notices through the app, this website or a contact address you have supplied. An electronic notice does not replace any delivery method or consent required by law. Keep your account contact information current. Support requests are not treated as permission for marketing.
These Terms, the applicable purchase information and any feature-specific agreement form the relevant service agreement. The Privacy Policy explains personal-information handling and does not create a broader content licence. In a conflict, mandatory law takes priority, then an expressly agreed feature or purchase commitment for its specific subject. Nothing excludes responsibility for misleading statements or rights arising from representations that the law protects. Apple’s app licence continues to apply to the licensed app.
Provisions about ownership, accrued payments, lawful retention, responsibility for past conduct and dispute resolution continue after use ends only to the extent needed for their purpose. Termination does not create a new permission to use your content. A provision that is invalid or unfair will apply only to the lawful extent; the rest of the agreement continues where it can operate fairly.
